A driver racing westbound on 4500 South near 2200 East in Holladay, Utah, lost control of his late model BMW and ran into two telephone poles, knocking down a power line. According to a report by KSL, a witness who saw the accident unfolding, said that the car first hit a power pole and started to spin and continued to spin as it moved out-of-control down the road. The car was carrying two men at the time. One of the men was ejected out of the car. Both men, it is reported, were seriously injured in the car wreck.
It would seem obvious that the man who was thrown out of the car did not have his seat belt on. This is unfortunate. If there is one thing we can count on, it is that there will be car crashes every day. Any one of us is much more likely to be injured in a car accident then in an airplane falling from the sky. Yet people who would wear a seat belt in a plane, continue to gamble that they won’t be in a serious car wreck and don’t wear their seat belt while in a car.
Some may question why the passenger got in the same car as this out-of-control driver. It is probably safe to assume that he didn’t know he would be playing pin ball with power poles when he got into the car. At any rate, he most likely will be able to make a claim against the driver of the car or his insurance company for the serious injuries he sustained. He can also make a claim against his own car insurance (assuming he has some) if the driver of the BMW is “underinsured,” or doesn’t have enough insurance coverage. (He should contact a personal injury attorney or lawyer to get the particulars.) This is an important component of insurance because it protects the insurer against careless or reckless drivers who don’t carry sufficient insurance to cover the cost of medical treatment, lost work, disability, pain and suffering, etc.
